Terms of Service — AeneasSoft

1. Service Description AeneasSoft provides an open-source AI Agent Active Defense platform consisting of: an MIT-licensed SDK (interceptor + circuit breaker), a cloud-hosted dashboard, and API services for trace ingestion, analysis and compliance reporting.
2. Open Source SDK The open-source SDK (agentwatch) is provided under MIT License ('AS IS', without warranty of any kind). No warranty is given for fitness for a particular purpose.
3. Data Processing AeneasSoft processes personal data on behalf of the customer as a data processor under Art. 28 GDPR. A Data Processing Agreement (DPA) is available on request.
4. Pricing All prices are exclusive of applicable VAT (Mehrwertsteuer). Current pricing is displayed at aeneassoft.com/pricing.
5. Price Changes AeneasSoft reserves the right to change prices with 30 days notice. Existing subscriptions are adjusted to new prices at the end of the current billing period.
6. EU AI Act Compliance AeneasSoft provides technical tools to support EU AI Act compliance. Legal responsibility for EU AI Act adherence remains with the customer. AeneasSoft assumes no liability for regulatory decisions regarding the customer's AI systems.
7. Liability (B2B) Liability for slight negligence is excluded in B2B relationships, except where cardinal obligations (Kardinalpflichten) are violated. Liability is limited to the amount paid in the month preceding the damage event.
8. Plan Limits - Open Source: 10,000 traces/month (self-hosted: unlimited) - Cloud: 100,000 traces/month - Enterprise: Unlimited (custom agreement)
Exceeding plan limits results in HTTP 429 responses until the next billing cycle.
